Senior Attorney

The Office of Counsel, which provides legal guidance and services to the Office for People with Developmental Disabilities (OPWDD) service network on the myriad of issues arising from the delivery of supports and services to individuals with developmental disabilities, is seeking a litigation attorney. This position will be within the Litigation and Human Resources Bureau. As a Senior Attorney focusing on litigation, the incumbent will perform the following duties:
- Investigate lawsuits and claims as well as CPLR Article 78 proceedings against the agency and support the Attorney General's Office in its defense of the agency, including assisting with preparation of pleadings, memorandums of law, and affidavits. Issue litigation holds to preserve evidence. Assist the Attorney General's Office with discovery, depositions and trial arrangements. - Provide advice and assistance to the Attorney General's Office and staff on issues related to individuals who are involuntarily committed to OPWDD care, are ordered into OPWDD care by a court pursuant to CPL 730 (lack of fitness to proceed to trial on a criminal charge; or who are under OPWDD supervision pursuant to CPL 330.20 (not guilty by reason of mental disease or defect). - Represent the agency in Family Court when OPWDD is required to appear, evaluate and find placement for the individual. These include FCA Article 10 permanency cases, FCA Article 3 juvenile delinquency cases, and FCA Article 7 PINS cases. - Review incidents for potential litigation matters and take steps to preserve records. - Provide advice to Counsel's Office attorneys and agency employees on litigation issues.

Salary Range:
From $88161 to $111111 Annually
Minimum Qualification
Candidates must be reachable for appointment on Current Civil Service Eligible List for this title OR Candidates must have one year of permanent competitive or 55-b/c status in the posted title and be eligible for lateral transfer; OR be eligible to transfer via Section (i.e. 70.1, 70.4, 52.6) of Civil Service Law. The transfer cannot be a second consecutive transfer resulting in an advancement of more than two salary grades.Estimated Salary: $20 to $28 per hour based on qualifications.

The fraudster will send a check to the victim who has accepted a job. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
